Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "user") and FocusBlinders ("we", "us", "our"). They govern your use of the FocusBlinders website at focusblinders.com and the FocusBlinders macOS application (collectively, the "Service").

By using the Service, you represent that you are at least 13 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

FocusBlinders is a macOS productivity application that monitors active windows and browser tabs on your device and uses a locally-running AI model to evaluate whether your current activity is related to a task you have defined. Based on this evaluation, the app may restrict access to applications or browser tabs deemed unrelated to your task.

All processing occurs locally on your device. The Service does not transmit your activity data, window contents, or task descriptions to our servers.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the FocusBlinders application on Apple-branded devices that you own or control, solely for your personal, non-commercial productivity purposes.

You may not:

• Copy, modify, distribute, or create derivative works of the app
• Reverse-engineer, decompile, or attempt to extract the source code
• Sell, sublicense, rent, or lease the app to any third party
• Remove or alter any copyright, trademark, or proprietary notices
• Use the app for any unlawful purpose or in violation of any applicable law

4. Waitlist and Communications

By submitting your email address on our website, you agree to receive communications from FocusBlinders including launch announcements and product updates. You can unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at hello@focusblinders.com.

We will not share your email address with third parties for marketing purposes.

5. Nature of the Blocking Feature — Important Limitations

You acknowledge and agree that:

• The blocking feature can be bypassed. A determined user can quit the app, restart their Mac, or use system tools to circumvent restrictions. FocusBlinders does not modify system files, firewall rules, or kernel-level settings.
• The AI judgment is not perfect. The local LLM used to evaluate activity relevance may make incorrect decisions — blocking relevant apps or allowing irrelevant ones. We make no guarantee of accuracy.
• You remain in control. You can end any focus session at any time. FocusBlinders does not permanently block any application or website.
• The app requires Accessibility permissions. These permissions allow FocusBlinders to read window titles and app names. You grant these voluntarily and can revoke them at any time in System Settings.
• We are not responsible for productivity outcomes. Using FocusBlinders does not guarantee improved focus, productivity, or task completion.

6. Accessibility API and System Permissions

FocusBlinders requires macOS Accessibility API permissions and Apple Events permissions to function. By granting these permissions, you authorise the app to:

• Read the title and name of your currently active window and application
• Read the URL of your active browser tab in supported browsers (Chrome, Safari, Brave)

These permissions are used solely for focus evaluation purposes. We do not read file contents, passwords, form data, or any other information beyond window titles and URLs.

You can revoke these permissions at any time via System Settings → Privacy & Security → Accessibility.

7. Webcam and Facial Data (Optional Feature)

A future experimental feature may optionally use your Mac's webcam to detect facial expressions as an additional focus signal. If you choose to enable this feature:

• No video is ever recorded or stored
• Only numerical feature vectors (e.g. eye openness, head angle) are extracted and processed in memory
• All processing occurs locally using Apple's Vision framework — no data is transmitted
• This feature is strictly opt-in and disabled by default
• You can disable it at any time in app settings

8. User Responsibilities

You agree to use FocusBlinders only for lawful purposes. You must not use the Service to:

• Monitor another person's device without their explicit consent
• Circumvent security or access controls on systems you do not own
• Interfere with or disrupt the integrity of any system or network
• Violate any applicable local, state, national, or international law

FocusBlinders is a single-user, self-directed productivity tool. It is not intended for use as a monitoring or surveillance tool on another person's device.

9. Intellectual Property

FocusBlinders and all related software, designs, trademarks, and content are the intellectual property of FocusBlinders and are protected by copyright, trademark, and other applicable laws. The "FocusBlinders" name and logo are trademarks of FocusBlinders.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without our prior written consent.

10. Third-Party Software

FocusBlinders may integrate with or depend on third-party software, including:

• Ollama — a local LLM runtime. Use of Ollama is subject to its own terms of service.
• Apple frameworks (Accessibility API, Vision, AVFoundation) — subject to Apple's terms.

We are not responsible for the availability, accuracy, or behaviour of third-party software.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free operation
• Accuracy of AI-based focus evaluations
• That the blocking feature will prevent all distractions
• Compatibility with all macOS versions or system configurations

We do not warrant that the Service will meet your specific productivity goals or requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOCUSBLINDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, profits, or business opportunities
• Productivity losses or missed deadlines
• Damage resulting from the app blocking access to a needed application
• Damage caused by the app failing to block a distracting application
• System instability or conflicts with other software

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $20 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitations on implied warranties or liability — in such cases, the above limitations apply to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless FocusBlinders and its founders, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We reserve the right to terminate or suspend access to the Service at any time, with or without notice, for any reason including violation of these Terms.

You may stop using the Service at any time by uninstalling the application and deleting your account (when accounts are available). Upon termination, your license to use the app is revoked.

Sections 9 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), and 13 (Indemnification) survive termination.

15. Updates to the App and Terms

We may update the FocusBlinders app and these Terms from time to time. We will notify waitlist members of material changes by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.

17. Dispute Resolution

Before filing any formal legal claim, you agree to contact us at legal@focusblinders.com and give us 30 days to attempt to resolve the dispute informally.

For users in the EU or UK: nothing in these Terms limits your rights under applicable consumer protection laws.

18. Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FocusBlinders regarding the Service and supersede all prior agreements or understandings.
